Contract terms and conditions
1) Scope of application
1.1 These general conditions of contract (hereinafter "General Conditions") of the lawyer Caterina Caput (hereinafter "the professional"), apply to all contracts stipulated by a consumer or professional (hereinafter "customer" ) with the professional, with reference to the services on sale on the professional's website. These conditions exclude the application of the customer's own provisions, unless otherwise agreed.
1.2 Pursuant to these General Terms and Conditions, "consumer" means any natural person who concludes a legal transaction for the purpose of protecting his personal and/or working sphere of rights, but which does not fall within the framework of his commercial activity or self-employed professional. By "professional" we mean any natural or legal person or partnership with legal personality who, in concluding a legal transaction, acts for purposes attributable to his commercial or self-employed professional activity.
1.3 These General Terms and Conditions apply to contracts relating to the provision of legal assistance and consultancy services, with the exception of any express exceptions to the General Terms and Conditions.
1.4 Legal assistance and consultancy services pursuant to these General Terms and Conditions mean all judicial and extrajudicial legal consultancy and assistance provided by the professional.
2) Conclusion of the contract
2.1 The customer can order the services by contact, directly or via the contact form on the website www.studiolegalecaput.it, with the professional. In the event that the order is placed via the online order form, after entering personal data, the customer, by clicking on the validation button at the end of the purchase procedure, provides the legally binding acceptance of the price of the services agreed with the professional. However, the offer can only be accepted if the customer, by ticking the appropriate box under the text: "I expressly declare that I have read and accept the general conditions of sale", confirms that he accepts the contractual conditions.
2.2 The professional shall send the order confirmation to the customer by e-mail or whatsapp message.
2.3 In case of acceptance of an offer via the professional's online order form, an assignment contract will be sent by email by the professional containing a quote for the requested activity. The contract must be returned in a signed scanned copy and the original will be archived by the customer.
2.4 If the customer acts as a consumer, the only language available for stipulating the contract is Italian.
3) Right of withdrawal
3.1 Consumers have the right to exercise the right of withdrawal.
3.2 The methods of withdrawal are regulated in the assignment contract.
4) Prices and payment conditions
4.1 The prices indicated by the professional are final amounts inclusive of the VAT rate, if applied, general expenses of 15% and CPA contribution of 4%, in addition to any out-of-pocket expenses, indicated in the estimate.
4.2 Payments must be made in the current currency in Italy, i.e. the Euro. The customer has various payment options available.
4.3 If the customer opts for payment with "Nexi", the payment will be managed through the Nexy Pay service provider, under the conditions of use of the application.
5) Applicable law, competent court
5.1 This contract is governed by Italian law.
5.2 For all disputes arising from the application of these General Terms and Conditions, the parties agree to derogate from the exclusive jurisdiction of the consumer's court, indicating the Court of Rome as the competent court.
6) Alternative Dispute Resolution
6.1 The European Commission has set up a platform for online dispute resolution available at the following link: https://ec.europa.eu/consumers/odr. This platform represents the point of reference for the out-of-court settlement of disputes arising from service contracts in which the consumer is involved.
6.2 The professional is neither legally obligated, but is prepared to participate in a dispute settlement procedure before a conciliation body.
